User Agreement

Terms governing the use of the Akashi Data Center website and services.

1. Acceptance

This User Agreement ("Agreement") governs your access to and use of the website akashi.cloud (the "Site") operated by Akashi Data Center LLP ("Akashi", "we"). By using the Site, you agree to this Agreement. If you do not agree, do not use the Site.

2. About the Site

The Site provides information about Akashi's data center facility in Astana, Kazakhstan — services, capacity, construction progress, investor materials, and contact channels. The Site is informational. It is not an offer to provide colocation, hosting, or any other regulated service. Any service is provided only under a separate written agreement.

3. Permitted use

You may view, browse, and download Site materials for personal or internal business purposes. You may not:

  • Use the Site or its content in a way that breaches applicable law.
  • Reverse-engineer, scrape at abusive rates, or interfere with the Site's operation.
  • Use Akashi's name, logo, or brand assets without prior written consent, except for fair reference (e.g. press citing Akashi by name).
  • Misrepresent your affiliation with Akashi.

4. Intellectual property

All content on the Site — text, images, video, design, code, technical drawings, and reports — is owned by Akashi or its licensors and is protected by Kazakhstani and international copyright and trademark law. "Akashi" and the Akashi logo are trademarks of Akashi Data Center LLP. Nothing on the Site grants you a license, by implication or otherwise, except as expressly stated.

5. Third-party links and content

The Site may link to or embed content from third parties (partners, regulators, press). We do not control those sites and are not responsible for their content or practices. Following an external link is at your own risk.

6. Forward-looking statements

The Site contains statements about future capacity, certifications, timelines, and investor outcomes. These are projections based on current expectations and are subject to risks and uncertainties. Actual results may differ. Investor materials are subject to the disclaimers stated in the relevant documents and to applicable securities law.

7. Disclaimers

To the maximum extent permitted by law, the Site is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

8. Limitation of liability

To the maximum extent permitted by law, Akashi and its directors, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Site. Our aggregate liability for any direct damages will not exceed an amount equal to KZT 100,000 (one hundred thousand tenge).

9. Indemnity

You agree to defend, indemnify, and hold harmless Akashi from claims, damages, and expenses (including reasonable attorneys' fees) arising from your breach of this Agreement or your misuse of the Site.

10. Privacy

Use of the Site is also governed by our Privacy Policy and Cookie Policy.

11. Changes to the Agreement

We may update this Agreement from time to time. Continued use of the Site after a change means you accept it. The "Last updated" date at the top of this page reflects the latest version.

12. Governing law and jurisdiction

This Agreement is governed by the laws of the Republic of Kazakhstan. Disputes that cannot be resolved through negotiation will be submitted to the competent courts of the City of Astana, Republic of Kazakhstan, unless mandatory law of your country of residence applies.

13. Severability

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions remain in full force.
